Terms and Conditions
1. Definitions
Company means Goodstays Waiheke Limited, NZBN - 9429053075062, being the accommodation manager operating under the relevant trading name. Lead Guest means the person who makes the booking and accepts these Terms. Guest means the Lead Guest together with every other person occupying or visiting the Property under the booking, for whose acts and omissions the Lead Guest is responsible. Property means the holiday accommodation booked.
2. Acceptance of Terms
By paying the required deposit or otherwise confirming a reservation, the Lead Guest accepts these Terms and Conditions and agrees to procure that all occupants and visitors included in the booking comply with them.
3. Booking Confirmation
A booking is confirmed only after written confirmation has been issued by the Company and the required deposit has been received. The Company acts as agent for the property owner unless otherwise stated.
4. Payment Terms
A non-refundable deposit equal to 20% of the accommodation charges is payable at the time of booking.
The remaining balance is due 30 days prior to arrival.
Reservations made within 30 days of arrival require full payment at the time of booking.
By providing payment card details, the Guest authorizes the Company to charge the deposit, the balance when due, and any other amounts payable under these Terms to that card. The Company will give the Guest reasonable prior notice before charging any amount other than the scheduled deposit and balance.
Prices are in NZD and include GST unless stated otherwise.
5. Amendments
Guest requested amendments are subject to availability and incur a $75 + GST administration fee plus any increase in accommodation charges. Amendments requested within 30 days of arrival are not guaranteed and may be declined.
6. Guest Cancellations
More than 30 days before arrival: the 20% deposit is forfeited.
Within 30 days of arrival: the Guest remains liable for 100% of the accommodation charges. The Company will make reasonable efforts to re-let the Property for the cancelled dates and, if and to the extent it succeeds, will credit the Guest with the amount actually recovered for those dates, less the 20% deposit and an administration fee of $75 + GST. Any shortfall remains payable by the Guest.
Cancellations must be made in writing and take effect only from the date the Company receives them.
No refunds are available for late arrival, early departure or unused nights.
Travel insurance is strongly recommended.
7. Cancellation by the Company
If a property becomes unavailable through circumstances beyond the Company's reasonable control, reasonable efforts will be made to offer comparable accommodation. If no suitable alternative is available, all monies paid will be refunded. Except to the extent that liability cannot lawfully be excluded (including under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986), this refund is the Guest's sole remedy.
8. Force Majeure
Neither party shall be liable for failure to perform obligations where prevented by events beyond reasonable control, including natural disasters, severe weather, government action, transport disruption, utilities failure, civil unrest or similar events.
Where a Guest is prevented from taking up a booking by a force majeure event, the cancellation terms in clause 6 continue to apply, and the Guest is encouraged to hold travel insurance. The Company may, at its sole discretion, offer credit or alternative dates.
9. Guest Responsibilities
Use the Property only for residential holiday accommodation.
Take reasonable care of the Property and its contents.
Report maintenance issues and damage promptly.
Lock the Property whenever unattended.
Leave the Property in a clean and tidy condition.
10. Occupancy, Visitors and Parties
Only registered guests may occupy the Property. Occupancy limits must not be exceeded. Parties, events, weddings, commercial activities, excessive noise and unauthorized visitors are prohibited unless expressly approved in writing. Breaches may result in immediate termination without refund.
11. Children and Property Suitability
Guests are responsible for determining whether a property is suitable for children or persons with mobility limitations. Children must be supervised at all times.
12. Pets
Pets are prohibited unless approved in writing. Approved pets remain the Guest's responsibility and additional cleaning or damage charges may apply.
13. Smoking and Vaping
Smoking and vaping are prohibited inside all Properties. Guests are liable for deodorizing, cleaning, repair and associated costs resulting from breaches.
14. Check-in and Check-out
Standard arrival and departure times are advised in booking documentation. Early check-in or late check-out (up to 12pm) may be available for $75 + GST subject to availability. Guaranteed extended access requires additional night's accommodation.
15. Security Bond and Charges
A valid Visa or Mastercard must be provided. The Company may pre-authorize or charge a bond and recover its reasonable costs and losses for damage, excess cleaning, missing items, call-out fees, legal costs (on a solicitor-client basis) and other amounts payable under these Terms. The Guest's liability for such amounts is not limited to any bond taken.
16. Cleaning, Damage and Maintenance
Guests must wash dishes, clean BBQs where provided, dispose of rubbish appropriately and report any damage immediately. Extraordinary cleaning, repairs and replacement costs will be charged to the Guest.
17. Special Property Conditions
Guests must comply with any Property-specific instructions relating to water conservation, septic systems, spas, pools, fireplaces, barbecues, electric vehicle charging, boats, kayaks or other recreational equipment.
18. Internet, Utilities and Third Parties
Wi-Fi and utility services are supplied by third parties, and uninterrupted availability cannot be guaranteed. The Company accepts no liability for outages beyond its control.
19. Lost Property
Items left behind will be retained for up to 30 days. Return is subject to a $75 + GST administration fee together with postage or courier costs.
20. Privacy
The Company collects and uses personal information for booking administration in accordance with the Privacy Act 2020. Guests authorize the Company to retain payment details for legitimate charges arising under these Terms.
21. Liability
Guests use the Property and all recreational facilities at their own risk except where liability cannot legally be excluded. The Company and Property Owner are not liable for loss of personal property, interruption to holidays or indirect or consequential losses.
22. Termination
The Company may immediately terminate a booking where these Terms are materially breached, illegal activity occurs, or the safety or quiet enjoyment of neighbors is compromised. No refund will be payable.
23. Governing Law
These Terms are governed by the laws of New Zealand. Any disputes shall be determined by the New Zealand courts.
24. Document Control
Version 3.0. This document should be reviewed annually and following any significant legislative or operational changes.
